Will a California Employer Find a Felony That's More Than Seven Years Old
    Good evening guys,

I recently just got the best job of my life (according to pay). It's with a California agency that is subcontracting me in DE. I was arrested in 2003 and have a full Governors pardon for everything. On the application it askes if i ever been convicted of a felony. The answer is yes, I was convicted in 2003.

Since the 7 years in past, and the company is running this application and its operations from CA, will this appear to them?

Also, the application that I sign says "I authorize the investigation of any or all statements contained in this application."

Does this authorize the user to pull my background? I believe in DE it does not.

The people responding are volunteers too. Operators are not standing by to answer the call.

The answer is it's all a matter of how hard they look. However, I'd be surprised if they didn't. Private background checks will find ten year old misdemeanors, let alone felonies. The trick is that you need to know what state's records to search. Obviously if you are in California and your conviction was in California, it will be obvious. We also run checks on the state the person is relocating from, has been previously employed in (from their resume), and went to school in. Of course, that wouldn't catch some Pennsylvania kid who got charged down in Ft. Lauderdale on spring break, but a 50 state check is quite a bit more expensive than checking one or two.

Dowell, i've been offered a job, be given the start date, told them about my background, I have a FULL govenors pardon on EVERY charge, and still turned down for the job. In fact if any trial lawyer wants to follow me around we'd make a killing. I can't explain to you how many times i've been told I have the job and then lose the oppertunity REGARDLESS of a full govenors pardon. In fact 3 times in the last year this has been the case.

A pardon does not mean that you did not do the crime in many instances .... you did give permission for a BR chk
