Parking Ticket Contains No Violated City Code or Statute
My question involves a traffic citation from the state of: Oregon
Hi, I received a packing violation. The violation does not make any mention of what City code I violated, or anything at all regarding any statute I'm supposed to be in violation in. Do I not have the right to know what I'm being charged with? Does the USC or some other code not say (reference please) that I Have a right to know what I'm being charged with?
Help appreciated. It seems to me this ticket would be completely invalid without that information.
Re: Parking Ticket Contains No Violated City Code or Statute
What does the ticket say? Does it, for example, cite you for parking on an expired meter?
Re: Parking Ticket Contains No Violated City Code or Statute
it says "parking violation citation" . "You're in violation of City of ... parking ordinance or State of Oregon parking statute. The specific parking violation and the fine amount i indicated below"
There's a ticket number, my license nuber, the fee amount, pay by date, location, lot number, space number, and "past 2HR" which is why I got the violation, agent number, date, time, and a phone number.
But nowhere does the ticket list the actual statute or ordinance (no statute, or ordinance number) I'm supposed to have violated.
Re: Parking Ticket Contains No Violated City Code or Statute
Well, obviously people here will tell you it is for staying past 2 hours.
But the KEY will be 'can you get the local authority to tell you the charge' and if they cannot, they have a problem.
Contact the city, say "I think I got a ticket but it got damaged, could you send me a notice?"
Just thinking out loud
Re: Parking Ticket Contains No Violated City Code or Statute
Well, I am trying to use this ticket as a learning experience in law. It's a cheap way. If I fail to get the ticket discharged because there's no city ordinance or state statute listed ( I very sure I have the right to know the statute or ordinance I violated ) then it will only cost me $22.
What I was hoping to get was some USC code or some such that states that tickets require to state the code of the violation in order to be valid, but I can try the defense without it too.
In summary, my defense would be that the ticket is invalid because it doesn't contain the code of the ordinance violated.
