Hot Chatting with a Minor
My question involves criminal law for the state of: arizona/colorado
Ok so i met this girl on a phone application for chatting who said she was 18, then after a little said she was 17, then for a long while she wanted to be boyfriend and girlfriend and wanted me to visit her but i said i was waiting til she was 18, so also wanted to talk dirty and send pics.
fast forward to the time she said she was going to be turning 18 and she gets weird, then she admits she is 15, at this point i told her i could no longer talk to her, she kept pleading and pleading and i said no, then she stopped talking so i figured it was over and done, then she text back saying she was in the hospital and had some cancer and that her dad keeps beating her and i am a good person i just wanted her to have someone to talk to, so i let her keep talking but was nothing sexual in nature after finding out her age. then i decided to let her know she was wrong for lying , well then i get text back from her dad threatening my life and saying he turned my info into the cops
my question is can i get in trouble? I was not out looking for under aged girls and was specifically looking for 18 and older. if anything im guilty of being a good person who believed a liar
if her dad had submitted my info to the police how long before i would know if he truly did or he was just trying to scare me?
she is in another state and i have never met her

I can't answer that question, but I will say this:
I assume any 'girl' wanting to suddenly chat with me on the internet is really a guy.

Common sense from when you were six years old, don't talk to strangers. :)

If I were you in this situation, I would take the tack that you have been carrying on legitimate conversations with an unstable person, and then you got a text message from an unknown person threatening to kill you.
I would take a photo of the text message, take the photo to the local police station, and ask them how to deal with it.
If you're a good guy, it's best to behave like a good guy, and that's the kind of thing a good guy would do.

Yes, yes you can. Quite a lot, in fact. ProTip: NEVER ENGAGE IN SEX TALK ON THE INTERNET WITH TOTAL STRANGERS. Because, as the old cartoon goes, on the Internet, nobody knows you're a dog. Or a minor. Or a cop looking to bust someone looking to meet up with a minor for sex.
With all the cancer and beating blah blah, it's unlikely that she's said anything to her father at all, and is simply looking to manipulate you. If her father has indeed found out what she's been up to, you'd likely have a knock at your door in short order. You'd do well to consider this a lesson learned, and henceforth do all of your thinking with the big head, because if you leave the little one in charge, you may end up in jail.

You need to get a copy of any text messages sent between the two of you. If she represented herself as a 18, then anything exchange between that period and the time that you learned she was 17 is of no consequence because in order to convict it needs to be shown that you knew, or should have known the person was underage. Once she announced she was 17 and you if you send text containing sexual conversation, then you are open to prosecution for that conduct. There is no law against simply talking to a minor.

13-3506.01. Furnishing harmful items to minors; internet activity; classification; definitions
A. It is unlawful for any person, with knowledge of the character of the item involved, to intentionally or knowingly transmit or send to a minor by means of electronic mail, personal messaging or any other direct internet communication an item that is harmful to minors when the person knows or believes at the time of the transmission that a minor in this state will receive the item.
That statute states that the person must know, or believe that the person is a minor. Although when dealing with people on a real basis there is little age affirmation defense. However, when dealing with internet traffic there are age affirmation defenses because without cooborating evidence there is not way to determine age, whereas in a real setting there are additional verifications that can take place.

What the statute says is that if the person knows or believes that the recipient is a minor, you're in trouble. I don't see anything that says they're guaranteed scot-free otherwise.
Besides which, we don't know which end of the conversation was in which state. This is an Arizona statute. What if that's where the girl is and our poster is in CO?

i really dont see how they can charge innocent good people with crap, if i go on and i specifically look for 18+ and they say they are 18 what are u supposed to do get a ssn and run a back ground check? I guess I will wait and see if I get contacted by the police, if i had known she was under 18 i wouldnt have been anything even remotely hinting at a sexual nature with her. if something like that is reported how long does it usually talk johnny law to get in touch with you? I mean the text just said this "believe this, if you ever contact my daughter again i will come for you. I turned your info over to the police. Run and hide, watch out the window for your life to end" I think it could of just been a stare tactic, after I found out she had lied i didnt have any sexual conversation with her. and with her telling me her dad beats her and all this other stuff i was acting as a person to talk to. so hopefully nothing will come of this cause i had no intention of meeting up with a minor or anything else, we were making plans to meet, but as soon as she told me she wasnt 18 i said i could not do it. now as far as saving messages, i didnt save them as there are many months of talk, I am in az she is co, so how or what statues do they follow? and simply if her dad or whoever told police an adult contacted his daughter, and that was it, would they even contact me ?
yes there was sex talk before i found out she wasnt 18, but its not like she said oh i 16 and then i replied i want to meet up, it was the opposite of that and i said i could not meet her unless she was 18 and i even asked her for a picture of her drivers license
I dont want to run to the cops and then start all this trouble only to find out it was the girl, her friend, her mom, or dad, just trying to scare the crap out of me.

I think the chances are very strong that it is someone (who I will not attempt to guess) trying to scare the crap out of you.
However, no one here is in a position to make declarative statements that you are unquestionably in the clear, either.
What you are supposed to do is not have sex chats with people you do not know.

well thanks cbg, yes i know this now i have never been in a position like this before in my life, nothing even remotely close, if i went to a party and there was even 1 underage person i left , just hope nothing comes from this except a lesson learned

I'll have to do some more research on the more applicable code sections (the one posted was a quick search of CO statutes), but even CO has language that indicates that the person must know, or have reason to believe the person is a minor. It is up to the state to show that the OP knew, or should have known the girl was a minor. In this case, the age is an affirmative defense.
18-3-405.4. Internet sexual exploitation of a child.
(1) An actor commits internet sexual exploitation of a child if the actor knowingly importunes, invites, or entices through communication via a computer network or system, telephone network, or data network or by a text message or instant message, a person whom the actor knows or believes to be under fifteen years of age and at least four years younger than the actor, to:

thanks for your guys help, i just really was hoping this would not ruin my life as i work 2 jobs and go to school so i would hate to lose what i work for over some stupid person lying
