    My question involves education law in the State of: FL

    Due to exhorbitant costs, I have had to transfer from a private university to a community college in my hometown.

    I have a balance due the university and have been making regular payments to reduce the balance to 0. The University refuses to release my transcripts until the balance is paid and I am unable to register for classes at the community college without a transcript. I am currently not attending classes anywhere. When I contacted the University, I was advised while they would not release my transcripts, they would be more than happy to give me a cumbersome loan so I could stay there.

    Is it legal for the university to withhold my transcripts (I have been making regular payments) and prevent me from obtaining an affordable education?

    It is legal for them to retain the transcripts until you have settled your entire bill with the university. If the university releases your transcripts now and you go on to graduate from another university, the first school has no recourse against you other than through the court systems to get their money. That can be time consuming and expensive. To avoid that, they hold the transcripts which in essence keeps you from graduating without starting over.
