Co-Signed on His Friend's Bond and Now He Can Go to Jail
My question involves criminal law for the state of: MD
my boyfriend lives in Maryland and back in september he co-signed for his friend to be released on bond. M (his friend) was let out on bond because MB(friend's girl) and BJ(my boyfriend) co-signed. MB was the first co-signer. now, M is locked up b/c they proved him guilty and has $1400 left to pay. MB, who was the 1st co-signer, listed no job but BJ listed job, he is laid off now. will they both go to jail for it? or just BJ? MB is trying to run from them and if BJ goes to jail, i will make sure they know where she is at!!!

They won't be jailed.
They'll simply be liable for the bond amount if it remains unpaid.

If they co-signed for the bond, why would they be in trouble? The bond is money to ensure appearance at court, nothing else. They might owe the bondsman money, but if they are running from the law then they did something else.

no, she is. my boyfriend is not. M went to jail for the crime and left the bond unpaid so they came looking for BJ and MB. the bondsman said BJ could go to jail for it, said it can be a felony. unless they are just trying to scare him

The bondsman is a liar. It is also a criminal offense in most states to threaten someone with criminal prosecution in order to collect a civil debt. Bonds have to be paid in advance. If the person who was out on bond was sentenced, then the bond money is returned to whoever put it up. I would suggest talking to your local legal aid. I would also go to the police and report the illegal activities of the bondsman.

They want their money.
Unless it can be shown that the people promising the money had no intent of paying when they signed, this should not be a crime.
However, since there may be circumstances not absolutely clear to us here, the people involved should contact an attorney to run the situation past them.

okay I'll tell you the whole story. back in september, M missed a phone call with his PO and that was a violation so they issued a warrant. the cops got him in the streets and he had a few pills in his pocket. well, he was arrested and sat in jail for a week until his girlfriend, MB, had money to bail him out. no one else would co-sign for M so MB got BJ to co-sign with her. MB was the 1st signer and BJ was the 2nd signer. MB listed no job but BJ did and now he is laid off. well, M is $200 behind in his payments (because he was convicted of the crime, has to serve 18 months(total left he has to pay is $1400)) and the bail people came looking for BJ. when he found out, he called the man and told him, he cant pay and the man told him it can be a felony. well, MB is the one who is hiding. i dont know why but she is. she has a newborn, guess thats why.
but that's the whole story.

Bail bondsman are prone to exaggerating the truth sometimes.
