    My question involves collection proceedings in the State of: Georgia

    I attempted a bankruptcy in 1993-94. I say attempted, I kept my car, because it was the only transportation I had to work. I moved and had a hard time finding work for a short time, but it was long enough the car was repossessed, and that canceled my bankruptcy.
    I simply moved on, and eventually married and built my credit back up. Now, I am still receiving letters and phone calls from debt collectors and this is from debts 17 years ago. Can they still continue to pursue these debts? and if not, how can I stop them? I don't answer the phone calls, I can usually tell they are collectors, and I just pick up the phone and hang up, and I throw the letters in the trash.

    The longest is 6 years for GA although they can try word games with any CC debt to try and keep it in play. The GA Court of Appeals ruled that CC debt SOL clock starts when the debt becomes due and payable. Hill v. American Express. Just send them drop dead letters. DO NOT throw any mail out without first reading it. If they sue you, you MUST respond. You would assert an affirmative defense that the SOL has expired if taken to court.

    oh, I always look to see what it is, because they try that little sneaky stuff, not putting a company name on the return address. They are all just those things saying, "You owe a balance of $1500, but you can clear this if you pay a one time payment of $275 immediately, or we can work out a monthly plan...etc

    There was an Caital One Fraud account opened in my name in May 2000 back in 2002 or 2003 i contacted the Credit bearu's they then removed it from my credit report now Capital One has came back and started a GARISHMENT on my pay check taking 25% per check can they do that since The Statue of Limitation have expired can they do that?
