    Second DUI Within a Year, Probation Violation - What to Expect for Charges
    My question involves criminal law for the state of: Iowa

    I received my 2nd DUI/OWI within a year last week. Since I was on two years probation (released to self-probation about four months ago), this was also a probation violation.

    The first one I received the minnimum fine, but 10 days in jail since it was my fourth lifetime (one in Iowa 14 years ago, one in CA 9 years ago, both past the statuate of limitations). I blew relatively low (.117) and have enrolled in an area substance abuse program with a 90% success rate.

    What can I expect as far as the probation violation goes considering the BAC and enrollment in a program? The violations were in two different counties. Could I expect a warrant, summons to appear in court, or just an extension of the probation period?

    Given the fact that I served 10 days and had 170 suspended, can I also expect them to bring back some or all of the 170 days?

    Any information would be most helpful.

    Generally speaking, jail time goes up with each new crime. I can't promise you that your renewed interest in treatment will convince a court to go easier on you - lots of people get interested in treatment when they think it will keep them out of jail, so the real question is how the judge interprets your acts and motivation. I suggest working with a criminal defense lawyer.

    So this is your fifth lifetime DUI?
