    Task Force Took Some of My Drugs
    My question involves criminal law for the state of: Maryland

    i was recently raided and went to court for it (only $500 in fines) but task force found 8.1 grams of weed and a bowl in my room and 10 grams of weed and some pills in my brother's room. its on the arrest papers, but while in court, the judge said it was only 3 grams for me and 5 grams for my brother. obviously task force took some weed and his pills. should i file a complaint to get them piss tested(and hopefully caught!)? if its illegal for me to do it, why can they?

    no.. i know i thought of that do and glad they took some..lol.. but i just don't see how its fair for them to do it while people who just use it for personal use get arrested for it!!

    Yeah... you are actually complaining you were not charged as you should have been...

    You are correct. Fair would have been you being charged with felonies due to the true amount you had. Maybe the cop was giving you a break... and now you are complaining about it.

    Never mind, I rescind my previous answer.

    You should march down to the police station and demand the police give you the dope back that you weren't charged for.

    wow real nice. i'm just asking a question on here and you get smart with me? nice. and it wouldn't of been a felony, only a misdameanor.

    The fact of the matter is that the officers were probably giving you a break. The additional narcotics not entered into evidence were either a. destroyed or depending on department policy b. placed into the appropriate property system to be used in counter-drug operations.

    You have 0 evidence the officers "used" your stash. Accusing them of such in open court will not help your case. You are free to file a complaint with the department but given your credibility, don't expect it to be taken too seriously.

    You should be thanking your lucky stars that they cut you a break.

    18 grams plus pills could be seen as "intent to distribute" and probably should have been.

    That would have made it a felony, bright eyes.

    wow, they should have different people answering this. it's not like i was going to re-open my case and trust me, they weren't giving me a break. they've done this to other people i've spoke to. i wasn't going to take it to court, just wanted to show my arrest papers and court summary of how it was different. they weren't worried about us distributing, well i can't say "us", i mean me. all they wanted was someone to snitch and i didn't.
    they question asked was if i SHOULD complain so MAYBE they can get piss tested and HOPEFULLY fired and MAYBE put some non-crooked cops on the force (almost all our cops in town are crooked). maybe one of you could give me a non-smartass answer to this question :) thanks

    and aren't you all the ones who are supposed to know the law? you can't put two different people's charges together to make a felony. MY 8 grams is a misdemeanor. my brother's could of been a felony but it wasn't since they took weed and dropped the pill charge.

    and i know this is irrelevant, but i just want to say that Maryland court system is messed up. i have 7 other felonies and is still on unsupervised probation, and the judge only saw one of my 2nd degree assault charges!! crazy

    Okay..non-smart response. You may file a complaint if you choose. If, as you claim, all the cops are dirty then nothing will be done about it. As has been said by multiple people, their response will be that they were giving you a break. You will not be able to prove otherwise. If you are really that concerned about it, you can try filing a complaint with the state police or attorney general. Absent evidence of serious wrongdoing, both are liable to accept the "we gave her a break and destroyed it" explanation of events. In all likelihood, the additional drugs were either destroyed or used for counter-drug operations. It is not uncommon for drug users/dealers to allege that officers stole some of their drugs and it turns out to be a false allegation more often than not.

    If both people live in the same home it is possible, although not very likely, that a prosecutor could have charged both of you with all the drugs found. Especially if they could establish you both were aware of the other person's stash and/or had ever had access to it. Whether it would have ended in a conviction, no one can say. A good lawyer would probably get it taken care of if you had enough money.

    Sometimes when drugs are seized they're in multiple bags or containers, and the police only test some (not all) of the drugs. When that occurs, they proceed with charges based upon what they tested and confirmed to be controlled substances. When the charge will be the same, one way or the other, they may simply want to avoid the cost and potential delays of additional testing.

    well, thank you. that was better. i guess there is nothing i can do. but mark my words, they will be caught one day!!
