Police Report on Background Check
My question involves a background check in Chicago, IL
About 3 years ago someone falsely filed assault charges against me. The alleged incident occurred over two years before that, about 5 years ago now. At that time a detective called me to discuss (I declined), collect contact info, and he gave me the police report number. He stated that the report was suspended and that "off the record this is the probably the last time you'll hear from me."
I went to emergency response training program about 2 years ago, which the police where involved in and an officer there who had done a background check on me asked me if I wanted to discuss the report which I declined to and I left. Beyond that I haven't heard anything else about this incident.
I was already employed when the report was filed and now I am considering apply to other financial firms.
1) What is the likelihood that this police report will show up on a criminal background check done by a potential employer? Keeping in mind I was never arrested, or taken in for questioning or anything beyond the descriptions above.
2) If it is likely that this report is going to be a background check, is it possible to have this police report expunged or sealed like other criminal convictions?
Thanks
Re: Police Report on Background Check
What shows up on a background check depends upon the nature and extent of the check. I haven't found a way to seal a police report in Illinois.
Re: Police Report on Background Check
You can petition to expunge the record of arrest by filing an expungement petition with the Clerk of the Circuit Court. You should go to the tenth floor of the Daley Center Monday -Friday at 9:00 a.m. and talk to the free lawyers at the expungement help desk. They can assist you with this.
