    Consequences to Parents for Requesting Emancipation of a Minor
    My question involves emancipation laws for the State of: Florida
    I adopted my son 15 year old son a few months ago. We have only had him for less than 2 years. His actions right now seem to suggest he thinks he can live on his own. I want to present him with another option when he gets home. He can live under my rules or he can work towards emancipation when he is 16 years old and we will help him with this. I love him and want what is best for him. Him running around on the streets is not good for either of us. But I want to know if there will be negative consequences against my husband and I. We receive an adoption subsidy for him monthly, if we give that subsidy to him, does that meet the financial burden or does he have to be working? I'd rather he be working because he needs to learn how the real world works but I'm just brainstorming.

    I have no information about your "adoption subsidy" and thus cannot form an opinion as to whether you would be eligible to receive it for an emancipated minor. I don't know how much money is involved, so even if I assume it will continue to go to you I have no way of telling you whether it would be sufficient for him to live on.

    The question is really if we give him money each month does that signify that he isn't able to care for himself or because the money is for his care could it be argued that it is his and he can have it.

    As I mentioned in your other thread, it's really a moot point since the chances of a court emancipating a habitual problem child are so slim as to be not worth mentioning.

    My initial thought was to try to stop this from being habitual. This is the first time he ran away and I wanted to present him with a "legal" option for accomplishing what he was doing. As I said in the other post, the longer this goes on the more aware I am that emancipation is not an option he is going to choose...at least not in doing so the right way.

    I don't think you fully understand yet. Even if he were to "choose" emancipation, the state is not going to approve it. The petition, even if submitted, would be denied.

    Have you considered family counseling?

    I mean, really... he has been in your home for 2 years and you want to present him with options for leaving.
