    Changing my son's last name
    My son's father has been in prison since he was a year old and before that didn't really have anything to do with him. We seperated when he was about 2 1/2 months and had a restraining order and he violated it many times. To make a long story short I have full custody of him right now he doesn't see him because he is in prison and my son will be 5 years old in October. I want him to have no visitation when he is out of prison because he has taken him from me 2 times before and he has threated to do it agian. I am scared for my family because he is crazy. I just want my son to have my married last name and my husband wants to adopt him and I don't know where to start, because I know the father will object because that's all he has and he just won't let it go. We just wnat him out of our lives.:( So please someone give me some feed back.

    If you wish to initiate step-parent adoption proceedings, a name change can occur as the result of the proceedings. If not, you can petition the court (most likely the one which granted you custody) for a name change, and should be approved if the court finds the name change to be in the child's best interest. Either way, the biological father will be entitled to notice of the proceedings, and either way the process will be easier with his consent.
