Child is Not Mine, Do I Still Have to Pay Child Support
My question involves paternity law for the State of: Maryland
At first I thought my son was mine, but a year or two later I found out he wasn't mine, through a paternity test I took, but I never told my wife that I did that. Now she wants a divorce, but doesn't know he's not mine. Will I have to pay child-support if I tell the court he's not mine?

how old is the child now? Were you married the entire time (throughout the pregnancy and subsequent years of the child's life?

When he was born we were not married. We were married before he turned one years old and he is turning 4, but we are not divorced yet, but she will be divorcing me soon.

did you sign an affidavit of paternity accepting paternity? If not, how were you determined to be the father?

Request DNA testing. They have to give it to you if you are charged with child support and you deny paternity.

Nope, but he should try that, because while they might not pay for the DNA testing, there is certainly an option to get it. And even if the state didn't pay for it, if he wasn't the father and was wrongly sued for child support, then he wouldn't be the one paying.
