Re: Sex Predator Sting Question
was he on "To Catch a Predator"?
what specifically is he charged with. Code (statute) numbers can help a lot.
but as a general answer; nothing you have argued is a defense for many possible charges. There is no difference between driving to meet the person and getting out and driving to meet the person and not getting out. The crime charged has already been committed. Getting out just makes it that much easier to catch the guy.
Depending what he said or especially if he sent pictures, there is a possibility of several crimes. Without knowing what was said and what crime is charged, there is no way to determine if the charges are proper.
the "must be 18 to post"; that doesn't mean an underage person cannot be there. It just means they will get booted if the site administrator catches them.

as provided in s. 775.082, s. 775.083, or s. 775.084.
Oh, that's some very serious stuff. That one charge is a 2nd degree felony. That's up to 15 years in prison and up to a $10k fine.
the lewd and lascivious conduct is the same I believe and the last one is either a 2nd or 3rd degree felony.
That is some serious stuff.
Of course he has a lawyer, right? I have to presume his current plea offer is a result of actions by his lawyer, correct?
Not sure what you are looking for. If the facts of the case meet the elements of the charges, not a lot I can suggest. Presumably his lawyer has reviewed the charges and the evidence and determined the charges are supported by the evidence.

well he was saying he wasn't being rated R when chatting . he said the undercover kept asking "what are we gonna do" and he would reply "nothing just hang out" instead of something sexual... but he was telling me he did say a few sexual things which i guess is why he got busted but he told me everything he said was indirect
yeah i got him a lawyer but the case discovery hasn't been presented yet. I'm really just looking to see if their is a defense i can help find to present to him or figure out what kind of sentence or plea bargain he's going to receive. Obviously he's probably gonna be a sex offender but do you think he'll be able to get house arrest instead of jail/prison time? im just trying to see some possibilities of whats going to happen to my little bro
Re: Sex Predator Sting Question
you do realize the police have a copy of a transcript of the conversation, right? They tend to not arrest people without some evidence of a crime. If there was never sex mentioned, he would not be in this situation. I do not think your brother is being completely honest with you.

this sounds like a plea bargain already.

they are trying to make him a sex offender plus max of 80 months or something like that
the full ride on each of the crimes is around 10 YEARS in prison. Sounds like they already offered him a reduction in exchange for a guilty plea. For anything specific, you would have to ask area attorneys or scour the court records for what is typical. The statutes list a penalty. What is actually given as a penalty is up to the court so there is no way to know what they typically sentence a person to without that research.

do u think its possible they will offer a plea bargain of house arrest + probation? the lawyer i hired hasn't told me anything for my brother because he hasn't got the case built up against him and wont get it for a few more weeks. have you ever seen any cases sentenced like this ? do you think his age, being a father, and no priors could effect the possible plea bargains/sentencing?
i've seen some of these teachers who have sex with students and other cases where these people just receive house arrest + probation+ sex offender registry and these are real people . my little brother wasnt even talking to a real person so wouldn't his deal be lesser then these people who actually have sex with minors and get caught?
Re: Sex Predator Sting Question
It's impossible to determine what a court might impose as a sentence. His lawyer and the specific courts treatment of this type of matter is the best source of determining what the court might impose. There really is no way to guess what might happen with any accuracy.
