Am I a Victim of Pregnancy Discrimination
My question involves labor and employment law for the state of: New Jersey
I'm 7 weeks pregnant with my first child and have been at my job for 3 1/2 years. We are a small medical billing office with under 5 employees. I took a supervisor position 2 years ago so that my boss can work a separate job where shes earning additional income. I was the bail-our girl that makde this place run smoothly and picked up all other co-workers slack and now due to my pregnancy my boss has now hired a full time employee that will be covering me when I'm out. Now my employer has reduced my vacation and sick days from what I have been getting which was 17 days a year to 8 and after talking to her I was able to get it to at least 11. Shes discriminating against me for my pregnancy and is now giving these days to the new employee since she knows she'll be there in the long run and cant afford to give it to us both. I feel extremely cheated! This is not fair how can I address this?

She changed only your vacation days - all other employees had vacation days similar to your allotment and no other employees had their vacation days adjusted?

We are a small office I was the only full timer the other employee I worked with was only a part timer so she got less beenfits then me hers have not been reduced but the new girl who is now here f/t in prep for when i eventually leave is now reaping all my benefits and shes taking away from me to give to her! I have earned my vacation and sick days by my senority and dedication to this company!

Unfortunately, your employer is too small to be subject to the Pregnancy Discrimination Act, so even if these actions are being taken because of your pregnancy, you have no legal recourse.
Sick days are not vested in ANY state, and vacation days are not vested in your state.

I might just mention that NJ Law Against Discrimination (LAD) including pregnancy discrimination applies to all employers regardless of the number of employees. This law is enforced by the NJ Division of Civil Rights.

Yes that's correct Im covered by LAD don't you believe this is a form of pregnancy discrimination I feel I have been demoted. I did inquiry to several attorneys.
