    My question involves juvenile law in the State of: West Virginia
    hello,i've been with my boyfriend for the last couple months,he is 22 years old and im 16.i just told him my real age and that i may be pregnant ,what i would like to know is,if i truly am pregnant ,will he get sent to jail if anyone finds out that he is the father? my parents does not know we are dating either because they always ruin every relationship i have.:wallbang:its is my understanding that because i am 16 and i gave him consent to have sex with me ,everything should be fine but im still not sure.please help me!!

    he thought i was 17 2 months away from being 18..and that was two months ago and 3 weeks from today..i came clean to him and he said that he didn't care and that he would do everything he could for me and the baby if i am pregnant

    Whether or not he'll be charged with felony sexual assault of the third degree (statutory rape in WV) will depend on the DA and how much math they want to do to figure out if you were actually 16 at the time of conception. If you were actually already 16, I don't see them pursuing it.

    With that said however, if you ARE pregnant, you can anticipate that your parents are nowhere near finishing "ruining" your relationship. They have the absolute legal ability to get a restraining order against your BF and to have him arrested if he contacts you in violation of that order. And, unless your parents are independently wealthy, they have no legal obligation to provide an ounce of support for the child, and if you end up on public funds, the state will go after your BF to establish paternity and collect child support from him so that he and you, and not the taxpayers or your parents, are supporting the child. He will have no legal rights to visitation until he establishes them in court, and should he do so, that STILL won't give him the legal right to see YOU against your parent's wishes (or in violation of a restraining order if they choose to take it to that level). In other words, the only way to keep seeing him is to NOT get pregnant.

    thank you aardvarc for ur reply.yes i turned 16 last year a couple months before i met him so there is no question about that. Even though my parents would be mad,if I know my parents (who are divorced) they would be supportive,and would just want to make sure that he would stick around and be there for me and the child. I was just making sure that the fact that he is 22 ,wouldn't land him in jail and take him away from the child just because of the age diffrence.
