The Mother of My Son Stopped Using My Last Name for My Son
My question involves name change laws in the State of Nevada. I had a so born out of wedlock 8 years ago. The Mom and I never married. My name was not on the birth certificate after the birth, but the Mother and I amended it legally a few years later to reflect on the Birth certificate. The Mother Moved to Nevada from Ohio about 3 years ago, because of work. I have now found out that she is using her maiden name for my boy and I have no idea why and can get no explanation from her.
Does the Mother have the right to change my sons name back and forth at her will? This does not seem right or fare to my son or me Most of the time I think even children born out of wedlock should have a right to the name of the Dad! I have always supported the boy and also active with him. I am no dead beat dad.

Why? Tradition? Your question seems less about the child's rights and more about your indignance that she's not calling him by your name.
That asked, the child still bears your last name. The name on his birth certificate is his legal name, and she cannot change that without your consent AND a court order. He's still John Tedsson, even if Mom is calling him John Momsson. Mom can CALL him whatever she - or he! - pleases, but his legal name remains unchanged.
