If you're stating that you've been out of status for three years, you're not only ineligible to 'transfer' your H1B, you're subject to a ten year period of ineligiblity to reenter the U.S. if and when you leave.
If you're stating that you never entered the U.S., your new employer can petition for an H1B on your behalf.
