    Wrongful Termination by Walmart
    My question involves labor and employment law for the state of: Connecticut
    ok here it goes-
    my mom, who by the way is the sweetest and most harmless old lady EVER, has worked for Walmart for the past 9 years. She has recieved certificates on being a "star" employee, excellent worker etc etc.She works 4-5days a week, a couple of hours day, just to give herself something to do. She is a cashier.Well, today she got fired. she got brought into a room,with her manager, who she knows veryy well, as well as an investigator. She had no idea what was going on. The man started askin her questions about "something" that happened about a month ago. My mom didnt think anything of it at the time. the investigator said that a customer was shorted 20$ change. mind you , that this "customer" came back after FOUR hours. so, at the time, they closed her register and counted it out, and it was checked to the penny. my mom vaguely remembered it. anyway, they said that my mom pocketed the 20$ they said they have it on survealiance camera. My mom was almost in tears. she did not and would never steal from anyone. she asked to see the tape and they said no. the man was almost bullying her, telling her, just give back the 20$ and you can get your job back. she said "im not returning money that i DID NOT STEAL in the first place. he told her, we know what you purchased through our store in the last year, what your husband has bought over the holiday season, and asked her how many grandchildren do you have? needless to say she is very shaken up and angry at the same time. she just wants her name cleared and her right to recieve unemployment benefits , while looking for another job.she no longer wishes to work for walmart as she feels she was so wrongfully accused and fired. keep in mind , that at 10 yrs of employment through walmart the cashier"s salary increases to 13$ an hr. my mom wasnt thinking anything about this until we spoke today. is it possible that this is all a "set up"? why wont they show her the tape? and after the investigator left the room, she looked at her manager and said "are you kidding? you know this is not true." her manager's response- "theres really nothing i can do if i want to keep MY job".. are these walmart's tactics to keep salaries low????? and what kind of legal help does my mom need to get her name cleared??? any wrongful terminatiin suit????

    This is not a wrongful termination under the law, because there is no law prohibiting an employees' termination under these circumstances.

    Clearing her name with whom?

    Was she, in fact, fired? I wasn't clear from your post. If so, probably, the best she can hope for if unemployment benefits, if she has enough wages in the base year to qualify. The employer would have to show convincing evidence that she stole to prevail, if they even choose to protest her claim.

    Just for clarification, a wrongful termination does not mean that you were fired for something you didn't do; it means that there is a specific law which prohibits the employer from firing the employee for this reason.
