Condo Association Informed Me They Will Tow Visitor's Car on Sight, Get an Attorney
My question involves towing laws for the State of: Vermont
By-laws state that each unit "will be assigned two parking spaces, one in the garage attached to building and the second space shall be in the driveway area directly outside of the garage associated with the particular unit. Several other parking spaces are located in and around the open areas. These are extremely limited, they will be available for visitors and guests on a first come, first served basis; they are not to be used as primary parking for residents." In another area it states that visitors' guests parking spaces are first come, first served, subject to rules and regulations that may be established by the Association from time to time.
Background I own my condo. On and off for the past year and a half a friend has stayed with me, while searching for a job in this difficult economy. Normally she parks in my additional parking space, but when my boyfriend is here she parks in the visitor's parking, as she is a visitor.
Current Problem I received a letter today that states "this is a heads up that your girlfriend's car will be towed (at her expense) each and every time she is parking illegally in the guest parking or obstructing the plowing necessary to clean the lot."
(According to the by-laws anytime it snows, you are not allowed to park in your driveway.)
Follow Up I spoke with the president of the association, who informed me that there was nothing I could do, since a board decision had been made. It is finalized and if I want to talk to them about the issue I need to hire an attorney.
I am aware that this is a very expensive process. Can they determine who is a visitor and who is a resident? My friend is from out of state, has out of state plates and is here on and off for a week or two at a time. There are 13 visitor spots surrounding my building, at any given time no more than four are being used. Please help me. This is my first time owning a home and it is a terrible experience as I have tried to limit the use of visitor parking spaces, but can the association tell me that my friends can't visit, when the by-laws don't specifically describe a "visitor," "guest," and "resident"? :wallbang:

I think if it went to court, you'd have a hard time selling someone who is "living with you on and off" is merely a guest. Let your BF park in the visitor slot (provided he isn't living there).
