Easement or Right of Way for Water Line
My question involves an easement in the state of: Pennsylvania
I have a roadway right of way to access my property from a township road. It crosses 5 or 6 properties. Everyone on the road uses the right of way as all of our driveways start off the right of way. All is well ans everyone gets along when it comes to the maintenance of our little gravel road.
I need to run a water line along the right of way about 720 feet to the city water tap-in. DOes my roadway right of way allow me any privilage to dig and install the water line? The 720 feet crosses two or three properties before reaching my property. The line would remain totally on the roadway until it reaches my property.
Re: Easements - Right of Way for Water Line
No, in general easements can only be used for their specific purpose. Any other use would be deemed a trespass.
But, look in your deed and plat records, there may be language included that allows for water lines to be installed in the right-of-way easement. If there is not, then you can have drafted up a water line easement, and if as you state, everyone is on good terms, they are likely to sign off on it.
