Eligibility for Oregon Healthy Kids
My question involves public health law in the State of: Oregon
My children (both under the age of 19) are covered under their non-custodial parent's group health coverage.
The custodial parent's income falls within the "no-cost" guidelines posted on the state's web site: http://oregonhealthykids.net/eligible.htm
There has never been a lapse in coverage. Do the children still qualify for the plan as supplemental coverage?

No family makes too much for Healthy Kids. Even middle-income families may qualify for coverage on a sliding scale. For example, a family of four can earn as much as $66,000 per year and may qualify for the low-cost option.
To be eligible, a child must be uninsured, under the age of 19, live in Oregon and be a legal resident. Family income will determine whether the child qualifies for the no-cost, low-cost or full-cost option.
Although there are exceptions, your child must have been without health insurance for two months prior to the date of your application for Healthy Kids. Exceptions to this waiting period include job loss or reduction in work hours, a child's serious medical need, if current or recent coverage is through COBRA, instances of domestic violence, very low income (less than $29,000 per year for a family of four), and other exceptions.
If none of the listed exceptions apply, call them in the morning and ask if there are others that may apply.

We are an Oregon (Portland) family of 5 and earn 68,000/year - just a little over that 66k mark. Does being a family of 5 make a difference and keep us in the low-cost option? Regardless, can anyone give a general estimate of how much insurance would cost us monthly for just the kids - all 3? They've been without insurance long enough that they're eligible in that regard. Thanks!

You cannot get Healthy Kids as supplemental coverage. The children have to drop their previous coverage in order to apply for Healthy Kids. If they fit into one of the uninsurance exeptions, they don't have to wait 2 months to apply but they do need to be uninsured in order to get Healthy Kids coverage.

The guideline for a family of 5 is $78,780/yr to fit into that Low-Cost option, which it sounds like you will be eligible for. It looks like you fall above the 251% marker which means your subsidy will be 85%. You will probably pay around $50-$60/month for all three kids.
