Emancipation and Moving to a New State
My question involves emancipation laws for the State of: missouri & minnesota
im 16 turning 17 in about 4 months, i live in missouri. im talking to my mom about her signing for my emacipation so its not a big court deal. i want to get emacipated down her and move to minnesota and get an apartment for me and my son so i dont have to have one of my parents cosign or have to get a roomate. is this idea even possible?

Not even close.
You have a child - that indicates that you need more, not less, adult supervision.
Even if your parent/s agree, the court is not going to order it.
Now if your legal guardian allows you to move out of state ...that's another thing entirely. But don't expect to be able to get an apartment or utilities in your own name.
Re: Emancipation and Moving to a New State
for the record i do not live with my parents i have been takingg care of my self for 2 years, except my mom still has custody of me
Re: Emancipation and Moving to a New State
So you're working full time, paying full market rent, utilities, clothing, health insurance, transportation, food, AND maintaining good grades at school?
Re: Emancipation and Moving to a New State
i have a 3.0 grade point average i pay rent, daycare, and my phone, i buy everything for my son i get heath insurance, i get our food and our clothes yes.
Re: Emancipation and Moving to a New State
The judge is going to ask - so I'm going to ask you too.
How are you, at 16 and with a child, able to do this?

First, your state does not have an emancipation statute. The case law providing a basis for emancipation dates back to the 1950's. I can't promise you that, even with an overwhelming case for emancipation, the judge will make this easy.
Second, it doesn't matter a lick if you're emancipated - the landlord can require a cosigner before leasing to you or decline to lease to you due to your being below the age of majority. An out-of-state emancipation order doesn't change that. Also your rent won't go down if you're emancipated - if you cannot afford a lease without a roommate, being emancipated won't change that fact.

In addition to the fact that - as Aaron said - your state doesn't actually have an emancipation statute...
...you absolutely would not qualify for emancipation based upon your circumstances.
You're a minor, with a child, on public assistance. You cannot take care of yourself. That much is painfully obvious.
