My question involves emancipation laws for the State of: Nebraska
I have recently confirmed that my 17 yr old daughter (18 at the end of March) who was supposed to be living with her mother has instead been living with her boyfriend for the past month. The only support she gets from her mother was paying tuition for the community college course she's taking. Other than that, she pays for her gas, insurance, food, clothing, etc. My ex-wife made the statement to me that she just as soon let her leave, that she doesn't want the mess around the house. She would not oppose her being emancipated (except I don't think she's thought that through regarding the impact to child support). I also know that as a 17 yr old, I can (and plan to) have the police bring her back to my house. I plan on telling her mother that I'm petitioning to be the custodial parent.
My question stems from the fact that she is very headstrong. She needs her car to get back and forth to work and high school/college (and it's not in my name). I may have the police bring her back, but odds are very strong she will leave again.
Since she will go back to him, and will be 18 in very short order, pays all her own bills, and none of the child support I pay (which is substantial) is going to support her, what are the chances I can get her declared as emancipated?
