    Can a Non-USA Citizen File Divorce in USA
    Hi,

    My my name is Rao I am an Indian and living in USA from past 6 years.I got married two years ago in India and she is also Indian citizen.Our marrriage is registered in India under Hindu marrige act.Now i decided to seperate from her as she is having some illegal contacts with her previous boy friends.Right now she is in India and she is not willing to come back to USA.We both stayed in Inida 3 weeks after marriage and we lived together in USA 1.8 years.This is my present situation and below are my questions.

    Q1) Can i file my divorce in USA with out having her in USA?I am living in USA from last 6 years and right now i am living in California from last one and half year.

    Q2)If i got divorce here in USA is that divorce valid in India?

    Q3)What is the procedure to apply divorce in USA.

    Kindly requesting you experts please help me out.

    If you meet the residency and jurisdictional requirements of the state in which you are located, you can file for divorce. Read the materials located here. However, I can't promise you that a court in India would view your divorce as valid - to determine that you need to consult a lawyer in India.
