Landlord Filed Bankruptcy
My question involves landlord-tenant law in the State of: Colorado
I have just requested my security deposit back from my landlord and found out that she filed for bankruptcy last year. Does this discharge her obligation to pay my deposit?
Thanks in advance.
Re: Landlord Filed Bankruptcy
Probably not, but you've given us no sense of the dates and timing involved.
Also, we're talking personal bankruptcy? Chapter 7 or 13? And you rented from her as an individual, not from a corporation (or LLC) she operated?
Re: Landlord Filed Bankruptcy
I rented from her as an individual. I do not know anything about the timing or details of the bankruptcy, as she just told me that it happened "last year." She is telling me that she does owe it to me, but is broke right now and will pay me later. I just wondered if I will have a leg to stand on if I need to pursue it further, as I don't know much about landlord-tenant law in CO.
