    Disqualifications for the Medical Field
    My question involves a background check in the State of: Ohio

    Where can I find the disqualifications for working in the medical field? I would like to have a copy to take to my lawyer tomorrow

    Your question is very vague.

    What position are you seeking?

    Different positions and even different employers will have different criteria; there is no set "list" of disqualifications which apply across the board to every single position that may fall under the umbrella of "medical field".

    medical assisting. i was told I wasnt allowed to work in the medical field due to my criminal record after the school I attended allowed me to go through with the program. now i am fighting to get my loan discharged. i tried going through the better business bureau and the school claimed they didnt find out about my background until the final months of school but are the legally supposed to run a background check before anyone enters a medical assisting program? also i did inform them of my background before i even applied for the school

    OK, who told you that you couldn't work in the medical field?

    What IS your criminal history?

    The school isn't required to run a background check - that's not their responsibility. It's up to the student to check State licensing requirements etc.

    i have domestic violence and aggravated menacing. i went through a rough patch

    i have been told by a few potential employers and i even tried going back to school for something else medical and when i explained my background they told me i shouldnt have even been allowed in the medical assisting program

    OK let me see if I have this right:

    You started (or perhaps have completed?) a medical assistant program. Now you're trying to discharge the loans because you believe the school had a duty to either inform you beforehand that you weren't suitable, or run a background check or both?

    And that you believe your background completely disqualifies you from a medical assistant position and the school should have known this?

    i have completed the program with tops honors and a 4.0gpa. yes i do believe that my background disqualifies me from working as a medical assistant based on what i have been told numerous times. i believe that if i shouldnt have been allowed in the program to begin with because my background wont allow me to work in the field then yes i shouldnt have to repay the loans. its not my fault that they allowed me in the program with full knowledge of my background.

    I hate to say this, but it actually IS your problem, not theirs, if you don't meet other requirements after you've completed the program. They aren't going to run criminal background checks on every applicant and I seriously doubt they will be held liable.

    Regardless, you need to check with the State licensing board in Ohio to see if your criminal history DOES disqualify you automatically.

    Frankly I think you have an uphill battle on your hands - your attorney is apparently asking you for something that doesn't exist, and you're probably going to find that the school has all kinds of disclaimers.

    What's perhaps more important though is that to discharge loans in bankruptcy, they must meet the Brunner standard - and that has nothing whatsoever to do with your situation. It's purely about hardship, not about whether you think it was unfair of the school to accept you or not.

    you would think that they should run background checks on people applying for school in the medical field....so issues like this dont arise

    Why is it their problem?

    I suppose that's what's confusing me.

    It's the student's responsibility to research before they waste time and money. Y'know?
