Credit Reporting and Chapter 7 in Community Property State
My question involves bankruptcy in the state of: Arizona Community Property
My wife filed ch7 and included my debts also. In Arizona I as a spouse am also afforded discharge. HSBC has been reporting the debt as 30,60,90,120 days late then charge off. They are still reporting a balance. I Have dipsuted this for motnhs. Today HSBC told me they do no acknowledge community property laws. Are they allowed to do that? I thought that if the issued credit in the state of Arizona they are bound by the bankruptcy alws of Aronza.

    Any help would be appreciated.

You do not have a full understanding of the type of "discharge" you get by virtue of being in a community property state. Rather than giving you a lengthy exposition, I'll suggest that you review this article which does a nice job explaining the various types of debt, what is and is not community property, and what protections flow from a spouse's bankruptcy.
