Radar Clocked 60, Cop Wrote 54
My question involves a speeding ticket from the State of: Florida, Polk county.

Alright well i was entering a 45 zone. Well aparently i missed the first 45 sign about 1/10th of a mile back and that this was the second 45 mph. I wasent to the sign yet and i was going est: 57-60. I slowed down to about 50, then i saw a cop turn on the lights. Pulled me over. Did usual routine, then came back and said " I clocked you at 60, but i entered 54 on the citation to be nice" Then i left with my ticket dissatisfied. So, now i'm looking at the situation, can they lie about the speeding ticket like that? I mean i don't want to go to court and say, he lied i was going 60 but he reduced my ticket to 54, and get my fine and points raised. So my question is can he do that and if not is it a good argument in court. It was a sunny dry day on a 3 lane highway, the officer was a state trooper. Also had another friend, who was coming home from school just like me, and gave him the same exact citation and said the same exact words to him. Does this mean that he could be just estimating our speed and writing our ticket at an estimate to give tickets? I saw several other people that day get speeding tickets, a few pulled into the gas station and the same exact stuff was said and same citation for $129 at 54/45. So is there any possible chance of getting the ticket dropped or points removed? Or should i just pay the ticket and take traffic school and be done with it. Also a friend told me to pay more than the citation states in a cashiers check, and when u get your refund in a cashiers check just tear it up and do not cash it and the ticket will not go on your record, that seems ridiculous and by no means would i do that; but out of curiosity i wanted to know. Any ideas for me people? Thanks very much.

So he gave you a break which may result in you paying a lower fine for a lower speed and he's a liar?

Why would it be? Then the case would just be your word vs. his. I guarantee that the trial court will side with the trooper.

No. It means your friend was traveling at the same speed you were.

Yeah. you can fight it, and risk paying the $500 and fee if you lose. Or you can pay the fine and go to traffic school. No points. It's all online too, making it so much more worthwhile.

Your friend is completely wrong. Don't do that. They won't refund it. The court will walk away with the extra money. I guarantee that. The ticket WILL go on your record and points WILL be assessed to your license, unless you take the ticket it to court or take some form of traffic school.

BTW: TG- I like your new location. hahahaha.

He did not say you would be dissatisfied ... lol .. really, you are not going to go to court to contest the ticket, right?

Ok, I guess I will go with the traffic school option. However I do have a question, I had a ticket about the same time last year, started traffic school on February 5, and completed on the 10th. I know it's 1 years time to take the course again, so on which date is that year from? February 5, or February 10?

I'm not completely sure about this, but I am fairly certain that it is one year from the date of completion.
