Adding husband name to Birth Cert., changing sons name
My son was born 10 years ago. The father claimed it couldn't possibly be his, and has had little contact with me since. I have spoken to him twice in the last 10 years, both initiated by myself. About 1 1/2 years after my son was born, I started dating my husband. My son has always known him as his Dad. We got married 5 years ago and had a baby. I want all of our names to be the same. My son has my maiden name as his last name, as there is no father listed on the birth certificate. What do I have to do to have the birth certificate changed to show my husband as his father? I am assuming this is an adoption. Does the biological father have to consent even though his name isn't on the birth certificate, and I have no idea where he is. I have never recieved a penny of child support from him. What do I have to do?

Your fastest path is probably the step-parent adoption. You would have to notify the putative father, as an interested party. If he consented, or failed to respond to notice, the court would likely approve the adoption.
