Child Support and Divorce
My question involves child support in the State of: Connecticut
I am about to processing divorce with my wife. As the time we were marrying, she had children with other man who i just knew. Of course, i am the legal father of these children and listed on the Birth Certificate as a father. We agreed to make the divorce as simple as it can be. I wish to have a divorce case without a child support problem
1. Should i change the name of the birth certificate prior to the divorce ?
2. Could she wave the child support for me to make things simpler ?
Thanks a lot
Re: Child Support and Divorce
1. What are you stating? That some number of years ago you voluntarily entered into acknowledgments of paternity falsely stating that you were the father? That you adopted the children? Something else?
2. Generally not. You would have to establish a valid basis for deviation from the support guidelines. Read this.
Re: Child Support and Divorce
1. I am thinking about changing the birth certificate so that the children would not belong to our marriage at all. But i don't think it sounds right
What step should i take to have a divorce without to pay the child support. I am not their biological father, but still on their birth certificate.
To clarity, my wife had children with other man when we were still married. This resulted me to be listed as a legal father on their birth certificates. We wanted to divorce each other. I am trying to find the way to get me out of child support. Since she agreed with me not ask for child support at the court, i try to find the easiest way to end our marriage

You are going to have to disestablish paternity of the children as part of the divorce process. That makes your divorce more complicated and you really need an attorney.
Re: Child Support and Divorce
And depending on the ages of the children, it may not even be possible.
Re: Child Support and Divorce
Just to confirm, do i have to pay child support to my non blood related children in Connecticut ? I am aware of some states still require child support in case of non biological parent. Please correct me if i am wrong
Thank you
Re: Child Support and Divorce
It's not about biology at this point - it's about legality.
If you are the legal father of any child, you can be required to pay child support until paternity is legally disestablished.
Re: Child Support and Divorce
thanks so much for the info,
One more question, to legally disestablished paternity, Is DNA test required or just the confirmation from the mother of the child ?
thanks again,
Re: Child Support and Divorce
How old are the children?
There is a reason I'm asking.
Re: Child Support and Divorce
