My question involves civil rights in the State of: wv... can a company that works with jail house phones. tape your personal calls even if the person that is in jail is not on the phone (the phone call was to his lawyer not to the jail house..an then we called the company an they even let us hear the taped conversation with the other party an let us hear a taped conversation with the person in the jailhouse) the phone calls we make to anyone seems to be recorded..an we have proof that the one was recorded that didnt even have the person in the jail was not even on phone an was not called from the jail house. it was a personal conversation called from my house to the lawyer . we cant even talk on phone normally because we are afraid we are being recorded even though we arent doing anything illegal an wasnt even envolved with the criminal action of the person in jail .. who is my brother.locked up in the jail house in wv southern regional jail..evreytime we call anyone the other person on the line hear beeps like we are being recorded of our personal conversations. the company that works with the jail house on phone calls is global tel link..we understand that the phone calls that the inmate makes to us can be recorded because its a federal offense..but i am not in jail an have nothing to do with what he did..so why should my personal phone calls be recorded to other parties..an when we called global tel link he made fun of it an said we would be laughed out of court with our lawyer, by the judge.. an at the same time he was letting me listen to a conversation that was recorded of the inmate an myself..which in itself is against the law..we need a good lawyer an advice on how to pursue this matter.

West Virginia is a one party state. Furthermore, the parties almost certainly you were informed that the call. The beeps are notice you're being recorded.

something you are saying doesn't make sense. So, a couple rules to phone calls with inmates.
Unless they are privileged such as with their lawyer, they are recorded.
Just what phone are you claiming is being recorded that didn't involve a jail or inmate? -

Um any calls an inmate makes are subject to recording...so them recording you talking to the inmate is not a violation. Them taping a conversation between the inmate and their attorney, absent some kind of court order, is a no no but most likely would only result in the contents of said conversations being ruled inadmissible if the prosecution tried to use them.Quote:

what im saying is. my personal phone calls are being recorded......without my knowledge....the way i found out is i called global tel link ,the company responsible for inmate callls, complaining about why my money was being deducted so fast,,,they let me listen to calls that my brother had called to me, an they also let me listen to a call thay i made to someone else,,not concerning a call that my brother made...in other words my phone calls are being recorded by global tel link..is that not against the law...does anyone understand this.....my personal calls are being recorded without anyones permission,,,,, i understand that inmate calls can be recorded..but this doesnt have anything to do with an inmate being on the phone....now do you understand..... i have gave noone permission to record my personal calls....

so, call the police and tell them your phone is being illegally recorded.
what I'm trying to figure out is why global tel link has anything to do with your personal phone. From what I have read, all they deal with is phones within jails and prisons. Why, or even how, would global tel link even have access to the conversations on your phone unless it involved a jail or prison? -
