    Allegations of Abuse Against Step-Father
My question involves child abuse or neglect in the State of: Utah

My daughters bio father's sister emailed someone on facebook stating that my daughters step-father was sexually abusing her. These allegations are completely false and were supposedly reported to child services in June, we have yet to be investigated. We are going to mediation with the grandparents for visitation rights and I am just wondering if this is something we can use against them since the aunt lives the the grandparents?

That would be your husband, yes?

Would you be able to prove that the Aunt actually sent the message? How were you made aware of the accusation?

Perhaps more importantly - you're in the middle of a GPV suit...how did that happen?

No - that does NOT necessarily constitute admissible evidence. Can you prove that the Aunt actually wrote it? Could she (and I imagine she will) say that someone else had access to her FB account? Or perhaps that the message is 'spoofed'?

    See where I'm going here?

With regards to the GPV - what exactly are they asking for? Are they filing for CUSTODY? 50%? Really? Or are they asking for visitation only?

There is a reason I'm asking these questions.

And - as far as your ex goes - I'm sorry for the loss...for your children, if nothing else. I guess I didn't get the LOL about that.

Could she (and I imagine she will) say that someone else had access to her FB account? Or perhaps that the message is 'spoofed'? The only actual proof i have is that she revealed personal information about the situation that no one outside of our 2 families would know, i have access to the actual facebook account where these emails are being sent so that might prove no spoofing. she has said that we have been trying to hack her account, but i have no information to even attempt to do it, i dont know her email address to even try.

    See where I'm going here?

With regards to the GPV - what exactly are they asking for? Are they filing for CUSTODY? 50%? Really? Or are they asking for visitation only? They are asking for visitation in the petition they filed. they are not saying what they want, we have tried to work this out since April without going to court to no avail, they just wont tell us what they want. They have said they want 50%, they have said they want custody, they said they just want to see her. I really have no idea and their lawyer wont tell our lawyer want they are wanting besides visitation.

There is a reason I'm asking these questions.
