    Arrears for Child Support in Bankruptcy
    My question involves bankruptcy in the state of: Michigan
    my question is: If you were sued for back childsupport, can you claim that item when filing bankrupcy, by it being a civil judgement, because you were sued for it? The reason that I'm asking this question is because when applying for bankrupcy relief it been on most application when applying, that you must report any judgements against you.

    You can claim the judgment for back support in the bankruptcy but it will not be subject to the Discharge.

    The bankruptcy judges just ruled on this issue, and ruled that Child Support arrears must be paid in full through the chapter 13. If your jurisdiction has similar case law, your payment will be quite high, since you will have to cure it through the ch13.

    No, you can not discharge child support in bankruptcy anymore than you can discharge a judgment for interntional torts, or federal student loans, or that RICCO judgment.
