Do you not think law enforcement has heard the "I was just scratching" story thousands of times from people that were, in fact, committing intentional acts. d.
sure they have. Haven't you read about the guy on the plane sitting next to a 17 yo girl. He took his because it was itching or burning due to spilling some hot sauce of some such lame excuse recently.
cops didn't believe him either.

Questions???
800.03Exposure of sexual organs.—It is unlawful to expose or exhibit one’s sexual organs in public or on the private premises of another, or so near thereto as to be seen from such private premises, in a vulgar or indecent manner, or to be naked in public except in any place provided or set apart for that purpose. Violation of this section is a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083. A mother’s breastfeeding of her baby does not under any circumstance violate this section.
History.—s. 1, ch. 7360, 1917; RGS 5445; CGL 7588; s. 1, ch. 61-51; s. 779, ch. 71-136; s. 3, ch. 93-4.
this is the charge i was talking about.
sure sounds like it fits. So, what did you tell the cops about you having this need to expose yourself? Did he believe you when you said you didn't mean to expose it to anybody?
Re: Unintended Indecent Exposure
Hey everyone, thank you for all of your help. I will be speaking with my attorney IF/when I am contacted by the DA.
Re: Unintended Indecent Exposure
cbg, stop playing with this guy, you know that the police will arrest him on January the 10th, 2011 at his place of employment. They will pull him out of his work place with all his coworkers and his boss watching and then send another police officer to his house to let his parents know. Just tell the guy so he can stop worrying.

Re: Unintended Indecent Exposure
I really don't understand why you guys have to be so cruel to me on here. What have I done to you. Why would you say I'm going to get arrested. I am just asking for advice. Like I said before, I mean no disrespect. I thought I have been very polite and now you all are turning this into a big joke. What did I say to deserve this. My last post was to thank everyone for the information.
Re: Unintended Indecent Exposure
You've been on here BEGGING us to tell you whether and when you were going to be arrested. WTG finally just gave in and told you what you wanted to hear.
Re: Unintended Indecent Exposure
First of all, you should consult an attorney about this. An experienced criminal defense attorney may be able to speak to the prosecutors who are now reviewing your case for a decision whether or not to proceed with charges and convince them that you had a bona fide medical problem that left you no choice but to expose your genitals in open view in a public place. The following statements aren't meant as legal advise, merely an academic discussion of how your facts illustrate various topics of interest.
Your post illustrates a prime example of why attorneys are constantly advising clients not to speak to the police. You had a right to decline to talk and confess committing a crime and youu unwisely decided to tell the police everything the prosecutor needs to have in order to proceed with a charge of Exposure of sexual organs, a first degree misdemeanor, punishable by up to one year in jail. This crime only requires that you "...be naked in public except in any place provided or set apart for that purpose."
Most likely the police officer was not sure whether to trust what the lady was saying and whether or not she actually saw what she thought she saw. Your "confession" cleared that right up. Now you need to get an attorney to speak to the prosecutor, because prosecutors will almost never speak directly to the accused individual except in court on the record. Nor should you attempt to speak to law enforcement your self, since everything you say can and will be used against you. In cases like yours, sometimes a letter or records from a personal physician which corroborates a medical condition which would cause severe genital itching would be helpful to convince the prosecutor that they shouldn't pursue charges in the case. Be aware that any medical records or letters you provide to the prosecution would become public record documents unless and until you get the charge sealed or expunged. Go see an attorney, and good luck. But in the future, you need to keep your pants on in public!

Are you kidding me, lol... "bona fide medical problem that left you no choice but to expose your genitals in open view in a public place"
If that were the case then every pervert in this country would use it. It's not like he put his hand in his pants and scratched an itch, he exposed himself.
If I were in Walmart and my butt had an itch would it be ok for me to drop my pants around my ankles and scratch my butt?

only if you had a bona fide medical condition that required you to scratch your butt while ignoring all reasonable thoughts of decency and modesty.
