Shoplifting No Court Case
My question involves criminal law for the state of: CA
If I am not mistaken if one was caught shoplifting but the individual did not go to court and did not get a civil demand they would in turn have no criminal record and can say"no" on their job applications if they had any criminal record since they were not charged for a Misdemeanor? If the person contacted LP and apologized and the ban was lifted so the individual can shop again at the store then the case would have been closed for a $3 item.
I want to advise my friend on what to put on the job application. He told me that the LP has not heard of a Retail Theft Database and that they only keep the records in store for their file. So it seems like my friend is lucky in that respect and he can apply to retail jobs since there would be no record of his actions. My friend learned his lesson and the LP Investigator accepted the apology and will allow him to shop again.
