    What Are My Chances of Being Emancipated
    My question involves emancipation laws for the State of: Washington
    I'm 16 I work weekends and some weekdays at McDonalds. I receive $1,100 in death benefits every month from my father. I was released in 2009 from foster care in AZ after 10 months to live with my sister in Bellingham WA. It's been a year here and things are not going very well constant arguing and disagreeing and yelling has became too much. I receive good grades in school and doing running start next year at Bellingham Technical College (BTC) to do welding. My family and I have many “blow up's" and now has gotten to the point where nothing is right. I am considering petitioning for emancipation and I kno what I need to do, my brother in-law has also told me who will not force me to stay if that's what I choose. I am very straight forward on this and since I can not have a lease in my name until I/if I get emacipated but when/if I do I plan to live close to the college in an apartment and expand my work schedule. I am also hoping I will still recieve my benifits every month as well. So basically my question is how likely do you believe my chances are of getting emancipated and, what else do you think I need/ should do to help my case? Thank you and have a great day.

    In Whatcom County? At 16, a past foster-care child, with no proven record of already being self-supportive? Virtually nil.

    Please take some time to read the "sticky" posts on this forum, and read the myriad other posts asking the same question.

    Emancipation is not commonly granted. And it is virtually never granted to a child who cannot prove that they will be or are already self-sufficient.

    That's what nil means, yes.

    Emancipation is for teens who find themselves in the extraordinary circumstance of taking care of themselves 100%, and needing to be able to enter into contracts to continue to do so. It's not for kids who are fighting with their guardians or parents. It's for kids with genuine need. It is very, very rare, unless your name is Miley Cyrus.

    I can prove I can live and be successful on my own I even have permission from my gaurdians.

    If you have permission from your guardians, you can live wherever you please, but that still is not going to get you emancipated.

    You need to ALREADY be living on your own and supporting yourself 100% (no help from anyone), including paying for your own medical expenses, groceries, utilities, incidentals - AND you need to remain in school and get good grades. Then, and only then, will your petition even be heard. You need to be able to prove a NEED to be emancipated, and frankly, I'm only seeing desire. They're not the same thing.

    im covered in all my medical, and dental. It comes out of the AZ cps system.Yes it is a want and trust me if you felt the way i did you wuld be wanting it too. How can i ALREADY be living on my own when im not able to put MYSELF on a lease? So basically the emancipation system is bullshit if your telling me you have to ALREADY be living on your own.     Oh, yes, you're a very special snowflake. No one understands you, everyone is just a big meanie poopie head who doesn't want you to be happy.

    Spare me, kid. My parents tried to kill me, and it practically took an act of some god or other to get me out of there. Sympathy? None. You're clearly not mature enough to handle life on your own, if you're not even able to grasp the idea of want vs. need and how both are seen under the law.
