    Civil Suit with Duane Reade
    My question involves court procedures for the state of: new york

    So i used to work for Duane reade. The Loss prevention people came in one day and said they know ive been stealing, they made me sign 3 peices of paper, one admitting to i took items, one saying i would pay then back(restitution), and one sayin i would receive a civil suit letter, also that i would be put in the retail theft database. The civil letter i receive stated that i have 30 days to pay $500............... Ive payed $525 for restitution. I have not payed the civil suit, what happens if i dont?? Can i get a lawyer to remove myself from the theft database? Im really in a dilemma right now im just 18, i have my whole life ahead of me and i feel like it all came crashing down because of this. PLEASE HELP ME.

    You need to stop repeatedly posting your thread to irrelevant forums in violation of the forum rules.

    If you don't pay a civil demand you can be sued. If you choose to take that risk, only time will tell if you're sued.

    No, you can not sue to get your name removed from the Theft Database. Don't want to be included on it - you should have thought of that BEFORE stealing.

    If you don't pay the $500 Civil Demand - they can double the amount. They can take you to Civil Court for it, and add in their attorney fees, which will make $500 seem like a bargain. And your credit history will be screwed.

    Seems the store did not press criminal charges. Be grateful for that. You won't have a criminal record on file, except for the Theft Database.

    If you want to fight it:

    - You've already been lucky that the store did not file Criminal charges against you. Just wanted you to pay back an amount and give you a Civil Demand notice.

    - You don't want your name in the Retail Theft DataBase....ok...go ahead and sue.
    You may get a lawyer who will laugh you out of the office.
    You may get a lawyer who will take the case.....at $300 per hour.....
    Please let us know how this works out in the the end.

    In the end im paying $1,025. -_- i dont want to be taken for a fool, im just curious on what rights i have, i was screwed over big time. The Loss prevention people made me pay more than what i stole, i just dont think its fair.

    Do you know what it might cost to have to have a Loss Prevention department?

    Do you understand why they need one?

    It's because people steal.

    The company has every right to send a much elevated civil demand in order to cover THEIR costs.

    $1,000! Are you serious, i didnt even steal $200 worth of stuff, other people that stole $400 and didnt even bother to pay the restitution, they didnt even say sorry, they didnt even show up to get their check, i had the decentcy to man up and atleast pay the restitution fee! The other people that stole told me that they didnt receive any civil letter, any phonecall anything! Why are they after only me!

    They're not just after you.

    And let's be honest - you really have no idea what is or isn't going on with someone else's legal case.

    Concern yourself with your own matter - trust me, you'll be far better off.

    You have no idea how lucky you are that the store did not call the police and have you arrested. You'd be paying a hell of a lot more in the end. And would have a criminal record that would make finding a new job extremely difficult.

    Since you are on the database - do not waste your time trying to find a retail job.

    You have paid restitution - my guess is because the store did not get their items back.
    The Civil Demand is a perfectly legal punishment for the stores time, efforts, costs of the security cameras and LP.

    You got off really lucky......
