Mans Name on the Birth Certificate
My question involves paternity law for the State of: Wisconsin
My son was just sent a letter by the State of Wisconsin requesting a paternity test. This came about from a brief relationship three years ago. The mother had the baby and had her boyfriends name put on the birth certificate as they were living together. The child is now 3 and she is requesting the test. The child lives primarily with the ex boyfriend and his new girlfriend. What are his obligations?

requesting or ordering? A court can order a DNA test. His failure to submit can result in a default finding he is the father.
So, depending on what exactly he received, he may have no obligation or it might be a really good idea to submit to the test.

I believe the mother is on some sort of state assistance and therefore the state is ordering.

I suggest he submit to the test. If he is the father, he will be required to pay child support. If he isn't, well, he won't have to pay child support, for that child anyway.
If he is established as the father, he will also have the right to seek visitation, and sometime in the future depending on how things go, even custody he wishes.
