Sexting Charges

My question involves criminal law for the state of: Massachusetts

Ok i'm 19 yrs old and exchanged sexual text messages with a girl who told me she was 18 and sent a photo of a girl who looks that age and she was actually a minor and I didn't know this can I be charged for sexting and endangering the welfare of a child?

Based on what you have posted, possibly. How old is she actually?

That's what i dont understand she's 12, i don't know how i didn't notice this. I didnt send any revealing pictures just text messages.

Have you been living under a rock for the last few years? You've never heard that kids lie about their ages on line? It never occurred to you to do anything except take her word for it? Never took any steps to protect yourself from lying teenagers by, like, maybe, not sending anything that could get you into trouble?

Don't you ever watch Dateline?

I am a teen i never heard of sexting till yesterday, plus how is it illegal to text the word kiss in a message.

No one said it was illegal to text the word, kiss. You said you sent sexual text messages. Make up your mind. What kind of messages did you send?

I text the word smooch and kiss alot, no body parts, caressing or anything of the sort. I meant sensual sorry. She's 12 with a mental disorder apparently.

And you are qualified to diagnose a mental disorder? She's 12. She's a child. You, on the other hand, are a legal adult, and one who doesn't apparently have the brains God gave the average two by four.

Lose her number and pray that her parents don't monitor her cell phone. Next time you think about sending anything remotely sexual OR sensual, make sure you know the person well enough to KNOW, not just THINK you know, how old they are. If there's any doubt about it, DON'T DO IT.

If you thought she was 18 and of legal age, I don't think you did anything wrong. I do not believe strict liability applies to sexting. Besides your texts were not really that risque. Now you know she is only 12, you can stop texting her. I think it would be obvious to anyone that you believed her to be of legal age, and you are not a sex fiend, and you seem quite sorryy about the whole incident, even though it wasn't your fault. The key thing of course is to stop contact with her. I do not think you have anything to worry about. Unfortunately, some people on this site, like cbg and libran, take great joy in trying to make people like you feel bad. Ignore them.

If you are really worried, call around to a few lawyers and ask if they do a free initial consultation. Then ask if you have committed a crime, telling them all the details you mentioned here.

And it's because of people like you that we continue to have people like the OP, who don't have brains enough to think through the possible consequenses of his actions and make stupid mistakes that could potentially land him in jail. Both of you need to FOCUS.
