Is Divorce Needed After Long-Term Separation

Here is my husband's situation:
my husband and his ex was married in 1992 in a Hotel in saint lucia they did not get any paper or marriage license, he had been separated from her ex for a 9 years now. Is it necessary to get a legal divorce or not ? If so, how can I obtain a copy of the divorce decree?Where Should A Divorce Be Filed? Can he finalize this divorce without her concent?
my husband and his ex live in massashusstes.
Here is my situation
i live in morocco. my husband filed an petition K4 for me,in the interview, the officer ask me if he was married, i said no but in the questions if he have relatives in USA, i said one daughter,then the officer requests certificate for my husband's previous mariage.
i can not bring this certificate to the consulate, because of my husband situatin's(see above).
I hope this is clear and if it isn't, please ask any questions to clarify

Your husband should discuss his situation with a lawyer in Massachusetts, who will help him determine if he needs to be divorced, and if his marriage to you is legal. If he wasn't previously legally married, then you can tell immigration that he has a child from a prior relationship but was not married to the mother. If he was, your marriage is likely void, and he would need to divorce his first wife before he could legally marry you.

but my husband and i have benn married in morocco in june 2005, this marriage is legal or valid in US?

That depends upon whether or not his prior marriage is valid.

and how to know if his previous marriage is valid ? we don't know if this marriage in that hotel in saint lucia was registrated or not? how can we do? must do the travel at saint lucia?
