Can I Ask for Child Support in Mexico if My Child is a U.S. Citizen
My question involves child support in the State of: California and Mexico
Hi everyone,
Ok well I am a U.S. citizen and so is my 3 month old baby, his father however is a Mexican citizen, he lives in Mexico and works for the Mexican government, heīs a police officer. I am also living in Mexico at the moment because itīs easier for me, but in all this time his father has only given me 25 dlls. His name is not on the birth cert. nor does my baby have his last name, but, I am willing to submit my baby to a DNA test. basically what I want to know is if I can petition for child support if my baby was born in the united states? Keeping in mind that his dad is Mexican and has a good job. Thanks everyone and I will appreciate all replies...

From my understanding, States have no jurisdiction outside of their sovereign territory, usually. You may want to discuss the situation with a consul and inquire if there is any recourse in the State you are currently in, regarding honoring a support order from another State, even if that State is external to the republic you are currently residing in.

I expect that you'll be able to petition for child support under Mexican law as the father is a Mexican national and you're all domiciled in Mexico. However, this is a U.S. forum and we're not well-positioned to advise you on Mexican law or court procedure.
