    Statute of Limitations: Violation of Probation/Deferred Sentence
    My question involves criminal law for the state of: Rhode Island

    I have a case wrapping up May of 2011, deferred sentence for two counts of Possession of Stolen Goods >$500.00. The period ran from May '06 until May of '11.

    In August of '08, a police complaint of "willful trespass" was filed against me and a few buddies. Obviously, I was nervous because I was on deferred sentence for the first offense, so I told my P.O., who in turn told me she wasn't going to violate me, but the court may elect to do so. Long story short, the complaint was dismissed with a 48'a.

    Is there a statute of limitations on violation of probation? Can I be violated after the terms of my deferred sentence expire in May of 2011?

    How have you violated your probation? You complied presumably with informing them of your arrest. You weren't convicted, the state dismissed the charges.

    They have three years, but I suspect that if you've not heard of anything by the time your probation is up, they'll quickly forget about you.
