    I recently was involved in a traffic accident in which no citation was issued. However, on the police report, my "Driver Contributing Code" was listed as "Failure to keep in proper lane".

    Technically, the street I was traveling on was separated by a dashed white line into two lanes, but pictures of the street show that the line is so faded that it is unable to be seen from a vehicle. The street is narrow, and if you look at all the traffic turning onto the street, you will notice that all vehicles straddle the two lanes.

    My question is this: If the lanes are not delineated by white lines, or the lines are too faded to be seen, am I responsible for failing to keep in the proper lane?olves a traffic ticket from the state of:

    Exactly how did the accident occur?

    I took a right turn at a green light onto a road with a double yellow line. The northbound lane (my lane) of the road was supposed to be divided into two lanes, but the broken white line has faded away and cannot be seen. Upon taking the turn and travelling ~100 ft., vehicle overtook me on the left and passed, but the vehicle did not have enough clearance and damaged the front end of my car.

    I believe that I can't be cited for failure to stay in lane, because it was impossible to know that there were two lanes. Also, the other vehicle improperly passed and cut back in too soon.

    The other vehicle's version of events, then, is that he was driving in his lane, you were in yours, and you cut into his lane when he was next to you?

    Have you made a complaint to whatever governmental agency is responsible for maintaining the road and its markings?

    The police report is important how? I don't see it being important at all and would likely not even be allowed into a civil hearing. The report just lists legal conclusions.
