Final Rent Payment
My question involves landlord-tenant law in the State of: Arizona
I submitted a Notice to Vacate to my property manager on 11/1/2010 informing them that I would be moving out of my apartment on 12/31/2010 and turning in my keys that day as well. 2 nights ago I came home to find a move out procedure packet on my door that stated that my final payment would be $844.00, which I assumed was the inclusion of my last water/trash/sewer bill.
Last night I went onto the website to pay my final bill and it said my final bill was 820.57I emailed my property manager to find out what the discrepancy was for and she told me that although I was moving out on 12/31/10 because my lease doesn’t expire until 1/1/2011, I was legally bound to pay $22.00 for the 1st of January.
Is she right?

It depends upon the terms of your lease, which I am unfortunately not able to review from here. If the lease ran Jan 1 through Jan 1, I would argue that the intent was for it to be twelve months, not twelve months and a day, and that the landlord's notion that the 12th month should have ended on 12/31 is a fault of his drafting and not something that would entitle him to additional rent; but I can't give you anything close to a reliable answer without reading the lease.
