When Does Toplessness Turn Into Indecent Exposure
My question involves criminal law for the state of: Massachusetts.
How much of a woman's chest must legally be covered in public in MA? If it matters, I specifically care about the cities of Boston and Cambridge.
I've seen people around with just electric-tape X's over their nipples, is that enough? Or is this illegal, and they just haven't gotten in trouble yet when I've seen them. Must the entire breast must be covered, or just the nipple? Must the entire areola be covered, or only the very tip?
What is the penalty for having something showing that isn't supposed to be?
Thanks for your help! I'm afraid I haven't had much luck digging around on my own on google...
Re: Topless in Boston/Cambridge Ma
As far as the state statute is concerned, it's not defined. It just lumps the term "indecent exposure" in with a lot of immoral activities.
The statutes do define nudity as:
"Nudity'', uncovered or less than opaquely covered human genitals, pubic areas, the human female breast below a point immediately above the top of the areola, or the covered male genitals in a discernibly turgid state. For purposes of this definition, a female breast is considered uncovered if the nipple or areola only are covered.
A separate health code law bars breastfeeding women from being considered nude.
