23 Year Old with a 17 Year Old

My question involves criminal law for the state of: Oklahoma. My employee who is a Hispanic guy came and asked me to giv ehim some advice. He doesn't understand the laws in Oklahoma very well but I was seeing if you guys could help me. He claims he had an American girlfriend and she told him she was 19 years old. He is 23 years old so he thought it was okay and with two consenting adults I know that he was not in trouble for that. The problem came yesterday when police showed up to his apartment looking for him with her parents.

They talked with his brother and it was found that she was actually only 17. I know that 16 is the Age of Consent in Oklahoma but what crime has been committed and what punishment can he face?

Your employee is going to have to talk to the police and find out what - if anything - he is being accused of. (Tell him to get a lawyer first.)

You are correct that the age of consent in OK is 16. Since the girlfriend is 17, statutory rape is off the table. There's no way for us to guess what else they might want.
