Out-Of-State College Emancipation
My question involves emancipation laws for the State of: North Carolina and/or Alabama.
I am a 17 year old male, and I currently live in north Carolina. I am graduating from high school in January, and have been accepted to the University of South Alabama for the spring semester. I was wondering about the circumstances that would be surrounding emancipation, if I were to take that road. My birthday is in September, so I'd be doing spring and summer semester while 17. I will not be living on campus, I will be living in an apartment with my 19 year old friend, who will also be attending the University. I do not currently have a job; however, when my mother died in 2005, I was left a large amount of money that I would gain access to whenever I began college. It is about 300 thousand dollars. I do intend to get a job in January, despite this. I am talking to my aunt and uncle about this. I am not some brat who doesn't like the rules his parents have laid down for him. I am an upstanding member of the community, and I receive only the occasional B. I am also an athlete. I know what emancipation will entail; but I believe that it will make many things MUCH easier for me and my aunt and uncle. Would someone advise me on this matter? I do not want to be emancipated now, but when I start college in January and will have access to the trust fund and most likely a job. Thank you very much.
Re: Out-Of-State College Emancipation
What is your purpose in looking for emancipation? What do you think it will gain you?
You can live independently without being emancipated if your parents/legal guardian agree. I think you may find that it will not accomplish what you believe it will since the rules are different when it is solely for college tuition reasons.
Re: Out-Of-State College Emancipation
Firstly, you cannot file for emancipation in Alabama. You're not a resident there, and won't be for some time after you PERMANENTLY move there. You'd have to file in NC.
Mr. K discussed North Carolina's emancipation statutes here. Go read that, read the stickies at the top of the forum, then come back and tell us why you think you qualify for emancipation and what the big emergency is.
