Intent to Use Drug Paraphernalia and Baggie with Suspected Marijuana Residue
My question involves criminal law for the state of: Maryland
Hi im am 20 years of age Looking forward to joining the navy. Me & some friends recently got pulled over because the police though we had weapons in the car (which were really paintBall markers)..... After pointing their guns at us & Sitting us on the curve, one of the Officers begin to search me, they find my cigarette Roller, cigarette rolling papers & an empty baggie in my front pocket which i forgot i had(& Which i am sure Smelled of Mari too) After asking me a million questions on what was in the bag & where did i hide the drugs.After not answering the officer they threaten to bring the K-9 unit out. I panic because my fear of dogs an yell "What the F*ck. Whatever you are looking for i dont have it on me". They let me be & turn to my friends...this was my first offense ever so they did not put me under arrest but gave me a Criminal Citation & told me to wait for a letter to receive my court date...
If you need more info, i can give it to you. But i'm really just trying to find out What i should expect in court, what my options are & if its possible to get these charges expunged... & i plan on getting an lawyer but i really just want to know a little more before i go in and spend a bunch of money.

You were detained and issued a citation...that is an arrest. What is the actual code section you are being charged with (it's on the citation)?

That would appear to be a criminal misdemeanor that is, for a first offense, punishable by a fine not exceeding $500. For subsequent offenses imprisonment not exceeding 2 years or a fine not exceeding $2,000 or both. (Maryland Code, Criminal Law § 5-619. Drug paraphernalia.) With no possibility of jail time it's not likely that you will be given a court-appointed lawyer. I suggest consulting a local lawyer about the chances of getting a deferral, and if you're in discussion with a recruiter talking about how the charge and its disposition may affect your enlistment.
