    Attorney Sued Me for Credit Card Debt
    My question involves collection proceedings in the State of: Texas
    I have been sued by an attorney in Texas (Seung W Chae, CACH LLC) for a credit card debt of $3,402.
    The summon stated METRIS (just metris) as the account opener.
    I have never own a metris account, but through google i found out that HSBC bought Metris in 2005. I had a HSBC card in 2007 but the account number provided does not match the HSBC account i had.
    I answered that i don't recognize the account and sent him a letter for more info. (certified mail) No reply yet.
    The court date is set for a Non-Jury Trial on Nov. 29, 2010
    What can i do to defend myself.

    I have a part time Job and a house.
    I know in texas, they cant garnish my pay.
    Please Advice

    Just show up in court and say you never had such an account, never heard of Metris. and they never answered your request for debt verification etc.

    Here, where I am, many creditors go to court hoping debtors would not show up so they don't have to do any work, and get a default judgment. This is because many of the law firms suing really has no idea if they are even suing the right person, or have a valid debt.

    In fact, judges are so tired of it at this point, that if the creditor cannot prove the debt by the court date, the case just get tossed. So, if I were you, I wouldn't worry about it, I would just show up.
