Expungement in Ohio, and Moving To Another State
I pled no contest to a Disorderly Conduct (M4) in Ohio a year ago. It is currently being expunged and should be expunged completely in the next week or two. I have accepted a job in Washington, DC, and for my job I have to send in a background check form. I also need to get my Social Work Licensure, and the licensure application requires me to disclose if i have ever been "convicted or arrested for a crime". Since this will be expunged before I have to do any of this do I still have to disclose it? If i do have to disclose how much do I have to say about what happened? I am confused as to whether my expungement means I can ignor it or not. I would appreciate any help....sorry for the long post.

You can check out this link on expungements in Ohio. Once the expungement order is entered, you can lawfully state you have not been convicted of the offense which was expunged, and the general public will not have access to this information.
Having said this, in most places expungement does not mean destruction of the records, so it remains on some criminal justice agency databases such as NCIC. Only certain entities, such as law enforcement agencies and prosecutors, can access these databases and when they do they will see you have an offense that has been expunged. In some places, there may be some employers who are authorized by law to have law enforcement do a background check for them for some jobs such as being a police officer, possibly working in a daycare around children, etc. Through that process, they may be able to find the person had an offense which was expunged, but generally employers will not be able to get that information.
So bottom line, when the order gets entered you do not have to disclose the information; whether you choose to do so voluntarily is up to you.

Thanks for the help, I appreciate it. I just don't want to lie or get myself in a bad situation, but if i don't legally have to disclose it then I don't plan to. Thanks again!
